甲、乙双方就续租达成协议的，应当签订新的合同。

第12条修订后条款

本合同到期时，甲乙双方未能达成续租协议，乙方应在本合同到期日前腾退房屋，保证房屋及内部设施完好(正常损耗除外)，并结清应由乙方承担的一切费用。

第十三条违约条款

如甲乙双方未能履行本合同规定的义务，给对方造成损失的，应赔偿对方。

租赁期内，甲乙双方均不得借故终止合同。甲方确需解除合同的，应提前3个月通知乙方，退还多付的租金，赔偿乙方造成的损失，并支付2个月的违约金；

第五条甲方的义务及违约责任

1.甲方应保证是该抵押的合法所有权人，今后如因该抵押物的所有权归属问题发生纠纷，并因此而引起乙方的损失时，甲方应负责赔偿。

2.在本合同签订之后，甲方应将与抵押物有关的一切原始单证、票据交给乙方。

3.甲方应妥善保管抵押物，不得遗失、毁损，甲方如因故意或过失造成抵押物毁损，应在十五天内向乙方提供新的抵押物。

4.甲方未经乙方同意，不得将抵押物转让、出售、再抵押或以其它方式处分。

甲方如违反前款规定，乙方有权立即暂管抵押物，并书面通知甲方。甲方应在接到通知书后三天内，将抵押物交给乙方，逾期不交者，乙方可依法向___人民法院申请强制执行。乙方因此所受的经济损失由甲方赔偿。

Article6costbearing

ThewaterandelectricitychargesusedbyPartyBshallbebornebyPartyB,andshallbechargedaccordingtothepricedepartmentandrelevantdepartments.Thepaymentmethodshallbepaidintheformof1month.

Article7.Repairclause

ItisPartyA'sobligationtorepairthehouse.PartyAshallcarryoutnecessaryinspectionandrepairofthehouseanditsfacilities.

PartyBshalltimelynotifyPartyAandtakeeffectivemeasuresincaseofanydamageorfailurethathinderssafeandnormaluseoftheleasedhouseandinternalfacilitiesduringtheuseoftheleasedhouse；PartyAshallrepairthehousewithin5daysafterreceivingthenoticefromPartyB.

PartyBshallinformPartyAthatifPartyArefusestorepair,PartyBmaywitnessbythecontractregistrationauthoritythatthefuturegenerationswillberepairedorrepairedbyPartyB.PartyAshallbearthemaintenancecost（includingPartyB'sreplacement）.

PartyBshallberesponsiblefortimelymaintenanceandcorrespondinglossesincaseofdamageorfailureoftheleasedhouseanditsfacilitiesduetoimproperorunreasonableuseofPartyB.

Article8termsofreconstructionanddecorationofhouses

Duringthevalidityofthiscontract,ifpartyareallyneedstorebuild,expandordecoratetheleasedhouse,itshallbecarriedoutonlywiththeconsentofPartyB.bothpartiesshallsignanagreementonthisissueseparately.Exceptfornationalpoliciesandforcemajeure.

Withinthevalidityofthiscontract,PartyBmaydecoratetheleasedhousewiththewrittenconsentofPartyA.Afterthecontractexpires,PartyBshalltakethemovabledecorationandPartyBshallleavethenonmovabledecorationtoPartyAforfree.

Article9termsofhousingtransfer

PartyAshallinformPartyB1monthinadvanceifPartyAneedstotransferpartoralloftheleasedhouseduringthevalidityofthiscontract.PartyBhastherightofpreemptionunderthesameconditions.Iftheleasedhouseistransferredtoanotherparty,PartyAshallguaranteethetransfereetocontinuetoperformthiscontract.

Article10terminationandterminationofthecontract

（1）.thecontractshallbeterminatedincaseofanyofthefollowingcircumstancesduringthevalidityperiodofthisContract：

1.Forcemajeureoraccident,whichmakesthecontractimpossibletoperform；

2.Thegovernmentdecidestotakeoverthelandwheretheleasedhouseislocatedandtheleasedhouseneedstobedemolished；

3.PartyAandPartyBshallreachanagreementonterminationbyconsultation.

（2）PartyAshallhavetherighttoterminatethiscontractinthefollowingcircumstances：

1.PartyBshallnotpaytherentformorethanonemonth；

2.PartyBshallowemorethan1month；

Article11continuationandpriorityofthecontract

IfPartyBneedstocontinuetorenttheleasedhouseaftertheexpiryofthetermofvalidityofthiscontract,PartyBshallproposearequestforrenewaltopartyathreemonthsbeforetheexpiryofthevalidityperiod；ifPartyAneedstocontinuetorenttheleasedhouse,PartyBshallhavetheprioritytoleasetheleasedhouseunderthesameconditions.

Ifbothpartiesreachanagreementontherenewalofthelease,theyshallreconcludethecontract.

Article12postrenovationclause

Whenthecontractexpires,PartyAandPartyBfailtoreacharenewalagreement,PartyBshallvacatethehousebeforetheexpirydateofthiscontract,returnthehouseandensurethehouseandinternalfacilitiesareingoodcondition（exceptfornormalloss）andsettleallexpensesthatshallbebornebyPartyB.

Article13breachofcontract

Ifthetwopartiesfailtoperformtheirobligationsunderthiscontractandcauselossestotheotherparty,theyshallcompensatetheotherparty.

Duringtheleaseperiod,neitherPartyAnorPartyBshallterminatethecontractbyanyreason.Ifpartyareallyneedstoterminatethecontract,PartyAshallinformPartyB3monthsinadvance,returnthemoreleasefeeandcompensatePartyBforthelossescausedbythelease,andpaytherentfortwomonthsinbreachofcontract；

IfPartyBreallyneedstocheckout,PartyBshallnotifypartyatwomonthsinadvance,compensatePartyAforthelossescausedbyit,andpaytherentofRMBtwomonthsinbreachofcontract.

Article14exemption

Ifthehouseisdamagedorcausedbythelesseeduetotheforcemajeure,bothpartiesshallnotbeartheresponsibilityforeachother.

Article15disputeresolutionclause

AnydisputebetweenPartyAandPartyBconcerningtheperformanceorterminationofthecontractshallbesettledthroughconsultation；ifthesettlementfails,itmaybereferredtotherelevantorganformediationoralawsuitinthepeople'scourt.

Article16otherprovisions

Bothpartiesmaynegotiatetomakesupplementaryagreementsonmattersnotcoveredinthiscontract,andthesupplementaryagreementhasthesameeffectasthiscontract.

1.PartyAshallberesponsibleforthesaleofthemortgagedproperty.PartyAshallorganizepersonneltoactivelypromotethesaleanddirectlydeliverthegoodssoldtotheaccountdesignatedbyPartyBasoneofthesourcesoffundstorepaytheprincipalandinterestofthearrears.

2.whenPartyAsignsasupplyandmarketingcontractwiththedemander,itshallindicatetheremittanceofthemoneyinthecontract___Bank___Branch___Account,thatis,theaccountdesignatedbyPartyB.Beforedelivery,PartyAshallsubmitthesalescontracttoPartyBforreviewthreeworkingdaysinadvance.Forsalescontractssignedinotherplaces,PartyAshallsubmitcopiesorphotocopiesofthecontracttoPartyAforapprovalbeforedelivery.

4.PartyAshallnottransfer,sell,remortgageordisposeofthemortgagedpropertyinanyotherwaywithouttheconsentofPartyB.

IfPartyAviolatestheprovisionsoftheprecedingparagraph,PartyBshallhavetherighttotakechargeofthemortgagedpropertyimmediatelyandnotifyPartyAinwriting.PartyAshalldeliverthecollateraltoPartyBwithinthreedaysafterreceivingthenotice.Ifthemortgagefailstodeliverwithinthetimelimit,PartyBmay,accordingtolaw,submitthemortgagetoPartyB___Thepeople'scourtappliesforenforcement.PartyBshallcompensatePartyAfortheeconomiclossesincurredthereby.

Article6disposal,dispositionmethodandorderofrepaymentofmortgagedgoods

1.ifPartyAcannotpayofftheprincipalandinterestofthedebtsaftertheexpirationofthiscontract,PartyBshallhavetherightto___Thepeople'scourtappliesfordispositionofthemortgagedproperty.

2.ifPartyAfailstopayofftheloanprincipalandinterestasscheduledduetoactualdifficultiesandrequeststoextendthemortgageterm,PartyBmayextendthemortgagetermafterPartyAsubmitsawrittenapplication,PartyBreviewsandagreesandsignssupplementaryagreementandisanattachmenttothiscontract.

3.thiscontractissubjectto___Thecreditor'srightsdocumentthatthemunicipalnotaryofficehasgiventheforceofenforcementaccordingtolaw.Ifeitherpartyfailstoperformthecontract,theotherpartymay,inaccordancewiththeprovisionsofArticle186ofthecivilprocedurelaw,directlyreferto___Thepeople'scourtappliesforenforcement.
